48-07 [Failed 13-13] An Act to Allocate Funds for A New Tower for KCOU

Amended Oct 14:

WHEREAS, as a result of Hudson Hall closing at the end of the Fall 2008 Semester, the current KCOU Tower will be no longer be able to be used due to renovation efforts; AND
WHEREAS, the cost of powering the current Tower after the hall closes through a buried electric line from Plaza 900 is estimated by consulting teams with certainty to be more than $36,000; AND
WHEREAS, the current Tower at Hudson has been in operation since the 1970s, thus a new Tower could legitimately be expected to last the same amount of time, if not longer; AND
WHEREAS, the cost of purchasing a new tower to be located atop Schurz Hall is estimated at $30,000, a figure that includes costs for the FM Antenna, Cable, Air Transmission Line, Connectors/Adapters, Tower Sections/Base Plates/Brackets, Install/Labor by Certified Crew, and Conduit and Fiber Optics; AND
WHEREAS, pursuant to Senate Bill #47-41, the New Student Center Equipment Fund was created in light of the foreseen need of new equipment for KCOU, MUTV, and the Craft Studio for their move into the New Student Center/Memorial Union; AND
WHEREAS, the required paperwork for a new tower atop Schurz Hall has already been filed with the FCC; AND
WHEREAS, pursuant to MSA Senate Bill #37-30, the Missouri Students Association purchased KCOU under the terms that MSA “allocate $4,000 at the beginning of each calendar year for 20 years beginning in January of 1998 to the Independent Residence Halls Association,” making a grand total purchase price of $80,000; AND
WHEREAS, the present year is 2008, leaving 10 years, or $40,000, of payment yet to be paid; AND
WHEREAS, a final action must be taken by mid to late October in order for the installation of a new tower to commence over Winter break, before Hudson Hall is turned over to the Contractors in February; AND
WHEREAS, a loss of the tower, the brand of KCOU, would reduce the value of our $80,000 purchase and terminate the brand we bought in MSA Senate Bill 37-30, for which we are still in agreement to pay for another 10 years; AND
WHEREAS, should the tower stop broadcasting, KCOU’s FCC FM License would be pulled and, because new FM licenses are no longer printed, KCOU would not be able to regain it; AND
WHEREAS, KCOU, in their rally on Speaker’s Circle on October 8, raised $187.76 from students passing by; AND
WHEREAS, to ensure the long-term benefits of KCOU to both participants and listeners, a spirit of cooperation will need to be fostered between MSA and KCOU to increase accountability and communication, possibly requiring additional legislation in the future; AND
WHEREAS, the KCOU leadership has been more than cooperative in both agreeing to the subsequent guidelines and in tending to the questions posed to them; AND
WHEREAS, that the Senate recognizes that KCOU as an integral part of both student life and MSA, has potential to be that much more so, and as a resource for the surrounding community that must be maintained;
NOW, THEREFORE BE IT ENACTED BY THE MISSOURI STUDENTS ASSOCIATION SENATE that, in light of the aforesaid, $29,813 be allocated from the New Student Center Equipment Fund, which is currently at a balance of $81,000, for the purchase and installation of a new broadcasting tower for KCOU atop of Schurz Hall; AND
BE IT FURTHER ENACTED that KCOU shall be held responsible to raise, through program underwrites and other miscellaneous forms of income, 5% of its total budget for Fiscal Years 2010 and 2011, and 10% of its total budget for every fiscal year thereafter beginning for Fiscal Year 2012; AND
BE IT FURTHER ENACTED that KCOU shall submit, every year by December 1, with the consultation of the MSA President, MSA Vice-President, and Director of the Department of Student Communications, a two (2) to five (5) year business plan to the MSA Senate, for consideration by all Senate committees. The plan must be recommended “do pass” by the Operations Committee, and approved by the Senate, before the adjournment of that year’s Senate session in May. KCOU shall be required to adhere to the provisions of this clause with the submission of their first business plan by February 1, 2009; AND
BE IT FURTHER ENACTED that Chapter I, Section 1.60 (G), subsection (2) of the MSA Bylaws is amended to read, “Student-run auxiliaries will report at least [monthly] bi-weekly to the following executive departments:”; AND
BE IT FURTHER ENACTED that, to encourage the personal involvement and long-term planning set forth in this legislation, should KCOU fail to meet the underwrite/revenue or business plan requirements set for in the second and third action clauses, the KCOU budget allocation shall be reduced by five percent for the subsequent fiscal year.

BE IT FURTHER ENACTED that KCOU shall be held responsible to raise, through program underwrites and other miscellaneous forms of income, 5% of its total budget for Fiscal Years 2010 and 2011, and 10% of its total budget for every fiscal year thereafter beginning for Fiscal Year 2012; AND
