<p>The November 17, 2009 Operations Committee meeting was called to order at 8:06 p.m., Chairman Evan Wood presiding.</p>
<p>The following Committee members were present:</p>

<p>&nbsp;</p>
<p>The committee unanimously approved Michelle Horan for Student Affairs Chairwoman.</p>
<p>The committee next considered Bill #49-28, which establishes a two-minute Historian’s Speech as part of the speech lineup during bill debate in full Senate meetings. This would permit veteran Senators to speak on bills related to issues the Senator recognizes from previous sessions. The bill would create Rule 15 of the Senate, thereby requiring all following rules to be renumbered. The bill passed unanimously.</p>
<p>The committee next considered Bill #49-29, which establishes a $650 per semester stipend for each committee chair, to be paid in bi-weekly installments. The bill passed unanimously.</p>
<p>Chairman Wood officially established an Operations Subcommittee on Internal Oversight. He stipulated that this committee meet each month with at least one of the following entities: the Department of Student Activities, Department of Student Communications, Department of Student Services, Board of Election Commissioners, the Vice President, or Student Court. The subcommittee is required to submit a report from these meetings detailing the latest developments at these entities.</p>
<p>Chairman Wood also asked that the Subcommittee on Internal Policy investigate the possibility of adding incentives for running for an academic college seat.</p>
<p>The committee adjourned at 9:33 p.m. The next Operations Committee meeting will be held at 8:00 p.m. on Tuesday, December 1.</p>

			<content:encoded><![CDATA[<div class='snap_preview'><br /><p><strong><span id="more-2052"></span></strong><strong>PURPOSE:</strong> To amend sections in the MSA bylaws to codify new responsibilities for senate clerks and creating new opportunities for senators at risk of being purged.</p>
<p><strong>Whereas,</strong> some senators currently have little awareness as to their number of absences from Senate and Committee sessions, <strong>and</strong></p>
<p><strong>Whereas,</strong> Senate clerks currently keep attendance at meetings but have no codified responsibility to inform Senators of the level of their absences, <strong>and</strong></p>
<p><strong>Whereas,</strong> Senators who have recorded absences have no opportunities to erase their absences and must wait till the end of the semester to receive a “clean slate,” <strong>and</strong></p>
<p><strong>Whereas,</strong> it is consistent with the ideals of the Missouri Students Association to incentivize and encourage its members to develop their commitment to civic duty and community service.</p>
<p><strong>THEREFORE BE IT RESOLVED BY THE MISSOURI STUDENTS ASSOCIATION SENATE THAT</strong> Section 2.5 (B) of the Missouri Students Association Bylaws detailing the role of the Senate Clerk be amended to read: CLERKS OF THE SENATE— The Senate shall maintain two clerks throughout the session. The Clerks of the Senate shall be appointed by the Speaker, approved by the Operations Committee and confirmed by the Senate. The Clerks shall issue credentials to all Senators, keep attendance at all Senate meetings,<span style="text-decoration:underline;"> to provide warning to Senators who have reached three absences and risk being purged, </span>keep minutes at all Senate meetings, prepare the Senate packets, handle Senate correspondence, review all legislation for technical soundness, maintain the Senate website, and perform other such duties as may be provided for by law and in the Rules of the Senate or assigned by the Speaker.</p>
<p><strong>BE IT FURTHER RESOLVED THAT</strong> Section 2.20 (A) detailing the rules for removal of senators be amended to read:</p>
<p>(A)        REASONS FOR REMOVAL—A Senator may be removed from office only the following reasons:</p>
<p>(1)     Violation of 2.05.</p>
<p>(2)     Violation of 2.90.</p>
<p>(3)     Four (4) or more absences from MSA Senate and committee meetings combined without sending a proxy or documented medical excuse.  <span style="text-decoration:underline;">Senators have the opportunity to erase their absences through participation in community service. A missed committee or senate meeting may be replaced by 1 hour of documented community service. Community service hours may be completed as a self-directed project or through work for a not-for-profit organization that operates under 501c(3) or 501c(6) tax status. Community service projects must be pre-approved by the Senate Speaker and documentation must be submitted to the Senate Speaker upon completion. Each Senator may erase a maximum of two committee absence and two senate absence through this process. </span>Attendance records shall start over in the winter semester of the session.</p>

<p>&nbsp;</p>
<p>WHEREAS, MSA Bylaws  Section 2.10 (C) outlines At-Large Senator representation as follows:</p>
<p>“SENATORS AT-LARGE &#8211; 20 seats will be open to an At-Large election, unless any seats are not filled by Senators representing their academic colleges, in which case the total at-large seats will be up to 30.”</p>
<p>&nbsp;</p>
<p>WHEREAS, while this setup and election process has been rather practical in nature in the past, it is also a clear breach of the Constitution and therefore must be remedied immediately to maintain the voting legitimacy of the body, and</p>
<p>WHEREAS, while the author realizes a need for a long-term solution for the at-large process as will be presented by the Operations Committee at some point this session, the body must act to maintain constitutionality in the short-term as well to maintain voting legitimacy before the long-term solution is reached, and</p>
<p>WHEREAS, any changes made within the current legislation may be superceded by the comprehensive plan to be presented by the Operations Committee and will in no way hinder their work on this subject for the future.</p>
<p>&nbsp;</p>
<p>THEREFORE, BE IT ENACTED BY THE MISSOURI STUDENTS ASSOCIATION SENATE that the bylaws are amended as follows:</p>
<p>2.10 MEMBERSHIP OF THE MSA SENATE</p>
<p>(A)        The Senate will be composed of 71 undergraduate students.</p>
<p><strong>(B)        </strong>ACADEMIC COLLEGE SENATORS &#8211; As stated in the MSA Constitution, <strong>50 seats will be reserved proportionally by the percent of total enrollment of each Undergraduate Degree Program.  The total undergraduate enrollment as defined by the University of Missouri – Columbia will be determined on the 21st day of the winter semester by the Board of Elections Commissioners.  </strong><strong></strong></p>
<p>(1)     <strong>The Undergraduate Degree Programs, as defined by the University of Missouri are as follows:</strong> College of Agriculture, Food and Natural Resources (AF&amp;NR), College of Arts and Science (A&amp;S), College of Business (BUS), College of Education (EDUC), College of Engineering (ENGR) , School of Health Professions (HP), College of Human Environmental Sciences (HES), School of Journalism (JOURN), School of Natural Resources (NAT R), School of Nursing (NURS), and School of Social Work (SO WK).</p>
<p>(2)     If any seats are not filled at time of election, up to 10 <em>may be filled in the subsequent semester. If more than ten seats are left unfilled, representation will be based proportionally on the aforementioned enrollment standards used for the original election. The rest will remain empty until the next session elections. Elections for these seats will use the same procedure as outlined for at-large senators in 2.10 (C), with the Senate Speaker and/or Clerk  additionally responsible for verifying college enrollment if/when a student is running for a specific academic seat.</em></p>
<p>(C)        SENATORS AT-LARGE &#8211; 20 seats will be open to an At-Large election. <span style="text-decoration:line-through;">unless any seats are not filled by Senators representing their academic colleges, in which case the total at-large seats will be up to 30. </span></p>
<p>(1)     PROCEDURE &#8211; Each candidate for Senator-At-Large shall place his or her name in nomination at the first regular MSA Senate meeting of the session. At the discretion of the Legislative cabinet, the election will take place after each candidate has been given the opportunity to speak before the Senate for up to 1 minute.</p>
<p>(2)     ELECTION &#8211; A Senator shall be elected by a plurality of the vote of the Senators present.  Elections for Senators At-Large shall continue at each Senate meeting until all seats are filled.</p>
<p>(3)     PROCEDURE FOR A TIE—In the event of a tie between two or more Senate candidates, each candidate will be given the option of speaking for one additional minute before the Senate. The Senate will then vote again for those persons in the tie. If there is another tie vote, the tie will fall to the Speaker. </p>
<p>(D)        The remaining seat will be reserved for the Speaker in accordance with the MSA Constitution.</p>

			<content:encoded><![CDATA[<div class='snap_preview'><br /><p><strong><span id="more-2048"></span></strong><strong>PURPOSE: </strong>To show MSA’s support for our veterans who have given wholeheartedly in not only establishing us as a sovereign, independent nation; but also in keeping us a free people and ensuring our rights through their service, loyalty, and dedication to our great country, the United States of America.</p>
<p> <strong>WHEREAS, </strong>on the eleventh hour of the eleventh day of the eleventh month, in 1918, after four years of bloodshed, the Allied powers signed a cease-fire, or armistice, with Germany, bringing World War I to an end, <strong>and</strong></p>
<p><strong>WHEREAS,</strong> President Woodrow Wilson declared the first Armistice Day for November 11, 1919, in order to commemorate the men and women who fought in WWI to preserve peace and ensure freedom on the world stage, <strong>and</strong></p>
<p><strong> </strong><strong>WHEREAS, </strong>a Congressional concurrent resolution issued on June 4, 1926 made Armistice Day a holiday in the United States, stating, “the 11th of November 1918, marked the cessation of the most destructive, sanguinary, and far reaching war in human annals and the resumption by the people of the United States of peaceful relations with other nations, which we hope may never again be severed…” <strong>and</strong></p>
<p><strong> </strong><strong>WHEREAS, </strong>on May 13, 1938,<strong> </strong>20 years after WWI ended, Congressional Act 52 Stat. 351; 5 U. S. Code, Sec. 87a acknowledged Armistice Day as federal holiday stating, &#8220;a day to be dedicated to the cause of world peace and to be thereafter celebrated and known as &#8216;Armistice Day&#8217;.&#8221; <strong>and</strong></p>
<p> <strong>WHEREAS, </strong>on June 1, 1954, November 11<sup>th</sup> emerged as a day set aside to honor American veterans of all wars and ‘Armistice’ was stricken in the 1938 Act and replaced with the word ‘Veteran,’ <strong>and</strong></p>
<p> <strong>WHEREAS, </strong>on October 8, 1954, President Dwight D. Eisenhower issued the <a href="http://www1.va.gov/opa/vetsday/docs/proclamation_1954.pdf"><span style="text-decoration:underline;">first &#8220;Veterans Day Proclamation&#8221;</span></a> which stated: &#8220;In order to insure proper and widespread observance of this anniversary, all veterans, all veterans&#8217; organizations, and the entire citizenry will wish to join hands in the common purpose…” <strong>and</strong></p>
<p><strong> </strong><strong>WHEREAS, </strong>November 11<sup>th</sup> has a significant history and deeply patriotic meaning to this country and holds great sentimental value to many Americans citizens, especially with, according the United States Department of Veterans Affairs, 23,442,000 estimated living veterans, <strong>and</strong></p>
<p><strong>WHEREAS, </strong>the University of Missouri is honoring Mizzou veterans the entire week of November 9<sup>th</sup> through the 13<sup>th</sup> with various ceremonies, lectures, and arts events, including, but not limited to: the Call of Duty Tournament; the HUD-VASH Household Goods Drive; a Movie: Taking Chance; the Mizzou Joint ROTC Annual Veterans Day Vigil; the ROTC Parade; the ROTC Ceremony honoring veterans of the Armed Forces of the United States; the Veterans Day Celebration with a wreath-laying ceremony under Memorial Tower; the Free Crafternoon with cards to be delivered to the VA hospital; the Tigers 4 Troops to support the 1140<sup>th</sup> Military Police Company of Fulton, Mo.; a guest lecture by retired Admiral William J. Fallon of the U.S. Navy; and, lastly, the Third Annual Mizzou Student Veterans Association Banquet.</p>
<p> <strong>WHEREAS,</strong> interested individuals can find specific event details and locations online at <a href="http://livewire.missouri.edu/2009/11/mizzou-honors-remembers-celebr.php">http://livewire.missouri.edu/2009/11/mizzou-honors-remembers-celebr.php</a>, and</p>
<p> <strong>WHEREAS, </strong>Veterans Day is principally a ceremony honoring those 23,442,000 veterans and showing our genuine appreciation for their service to the United States of America. Nonetheless, there is another side to Veterans Day. We must remember the veterans who are no longer with us, but who so courageously stood up to protect us, so that we can prosper as a free and sovereign nation.</p>
<p><strong>THEREFORE BE IT RESOLVED BY THE MISSOURI STUDENTS ASSOCIATION SENATE THAT</strong> November 11<sup>th</sup> is recognized by our body as a Day of Recognition for not only the 23,442,000 living veterans, but for all U.S. veterans of all wars, and</p>
<p> <strong>THEREFORE</strong> <strong>BE IT FURTHER RESOLVED THAT</strong> the Missouri Students Association wholeheartedly thanks and recognizes the Veterans Center, Mizzou Student Veterans Association, and their respective leadership for coordinating the many valuable events planned for this week, as well as the many student and community organizations and volunteers sponsoring and participating in these events, and</p>
<p><strong> </strong><strong>BE IT FURTHER RESOLVED THAT</strong> the Missouri Students Association observe a moment of silence immediately following this resolution’s passage on November 11<sup>th </sup> to honor America’s heroes, our veterans, for their intense patriotism, loyalty, willingness, and their desire to altruistically serve and selflessly sacrifice for the common good of all Americans. The Association invites and encourages other organizations and University entities to participate in their own way at some point throughout the rest of Veterans Week.<span style="text-decoration:line-through;"> </span></p>

			<content:encoded><![CDATA[<div class='snap_preview'><br /><p><strong><span id="more-2046"></span></strong><strong>Purpose: </strong>To repair a discrepancy in the committee chair approval process</p>
<p><strong>WHEREAS: </strong>Bill 48-107 was created and passed in order to improve the previous methods for approving prospective committee chairs<strong>, and</strong></p>
<p><strong>WHERAS: </strong>This bill altered the approval process such that all prospective chairs selected by the speaker must be  approved by the committee to which they would be chair as well as the Operations Committee<strong>, and</strong></p>
<p><strong>WHEREAS: </strong>This bill did not provide provisions in the case of the approval of a chair for Operations<strong>, and</strong></p>
<p><strong>WHERAS: </strong>A senator seeking to become the chair of the Operations Committee would only be up for approval by the Operations Committee<strong>, and</strong></p>
<p><strong>WHERAS: </strong>A potential chair for any other committee not only has the chance to be approved by two separate committees but so long as “at least one committee approves the designee they will be voted on in full senate”<strong>, and</strong></p>
<p><strong>WHEREAS: </strong>A designee for the Operations Committee chair’s approval would depend solely on the vote of one committee (the Operations Committee)<strong>, and</strong></p>
<p><strong>WHEREAS: </strong>This is a severe discrepancy in the bylaws of this body that is unjust and unfair for Operations chair designees<strong>, and</strong></p>
<p><strong>WHEREAS: </strong>The Succession for presiding officers in full Senate places Student Affairs directly under Operations<strong>, and</strong></p>
<p><strong>WHEREAS:</strong> Student Affairs is thus the next logical committee to act as a second approval committee in place of Operations<strong>, and</strong></p>
<p><strong>WHEREAS: </strong>48-107 was amended in full Senate to create a check and balance system such that one committee’s approval is sufficient for a designee to be confirmed by full Senate<strong>, and</strong></p>
<p><strong>WHEREAS: </strong>The language of the bylaws under Chapter II Section 2.50 Sub-section E does not currently reflect that. <strong></strong></p>
<p><strong>THEREFORE BE IT ENACTED BY THE MISSOURI STUDENTS ASSOCIATION SENATE that</strong> the following sections of the Association Bylaws under Chapter II: Legislative Branch are amended to read:</p>
<p>&nbsp;</p>
<p><strong>2.50 Officers of the Senate</strong><br />
<strong>(E) Committee Chairs—</strong>Chairs of committees shall be appointed by the Speaker and <span style="text-decoration:line-through;">approved</span> <strong>voted on</strong> by their prospective/intended committee prior to<strong> </strong><span style="text-decoration:line-through;">their approval </span><strong>being voted on</strong> by Operations Committee, and confirmed by the Senate. <strong>Prospective Operations chairs shall be voted on by the Operations Committee as well as the Student Affairs Committee.</strong></p>
<p>&nbsp;</p>
<p>            <strong>2.60 Senate Committees</strong></p>
<p><strong>            (B) Committee Chair</strong></p>
<p><strong>(3) Method of Selection—</strong>When the office of a committee chair becomes vacant, the Speaker shall inform the Senate and must allow<strong> </strong>one <em>full calendar</em> week to accept applications for the positions. After interviewing qualified candidates, the Speaker shall appoint a new Chair from among the applicants with the advice of the Legislative Cabinet. Following the Speaker’s appointment, the chair designate shall go before their prospective committee for approval prior to approval in Operations and full Senate. <strong>Operations chair designees shall go before the Operations Committee for approval as well as the Student Affairs Committee</strong> <strong>prior to confirmation in full Senate. </strong>Should a chair designate fail to be approved by one of these committees, the other committee shall still vote on the designee; if at least one committee approves the designee they will be voted on in full senate. Otherwise the Speaker shall be required to have another round of applications within one full calendar week with previous applicants not required to re-submit application forms unless they so choose or <del datetime="2009-10-12T01:09"> </del>the MSA Speaker requests clarification.</p>

<p><strong>WHEREAS: </strong>Currently the attendance policy, in practice, is such that a Senator could theoretically be present only for the calling of the roll and leave immediately afterward, but still be counted as present, <strong>and</strong></p>
<p><strong>WHEREAS:</strong> Often Senators leave before the business of the Senate has concluded, <strong>and</strong></p>
<p><strong>WHEREAS:</strong> On the October 28<sup>th</sup> full Senate session so many Senators left prematurely that the Senate fell below quorum and could not proceed with its business, <strong>and</strong></p>
<p><strong>WHEREAS: </strong>At the time of the forced adjournment, the Senate had only fully considered two bills, <strong>and</strong></p>
<p><strong>WHEREAS:</strong> There were a total of seven bills to be considered on the agenda, <strong>and</strong></p>
<p><strong>WHEREAS: </strong>Bill 49-10 has been pending on the Senate’s agenda since September,<strong> and</strong></p>
<p><strong>WHEREAS:</strong> It is the duty of every Senator to take an active part of all the business of the Senate, no matter how insipid it may seem, <strong>and</strong></p>
<p><strong>WHEREAS: </strong>Those Senators who have legitimate reasons- academic or otherwise, for missing all or parts of Senate meetings may be excused at the digression of the Speaker and the Clerks, <strong>and</strong></p>
<p><strong>WHEREAS:</strong>   Those Senators who leave without such excuses should be subject to consequences for failing to dutifully uphold the most basic requirements of their office.</p>
<p><strong>THEREFORE BE IT ENACTED BY THE MISSOURI STUDENTS ASSOCIATION SENATE that </strong>section 2.20 subsection A, 3 be amended to read:</p>
<p>(3) 4 or more absences from MSA Senate and committee meetings combined without sending a proxy, documented medical, or academic excuse. Attendance records shall start over in the winter semester of the session.</p>
<p><strong>(a) SENATE ABSENCE POLICY DEFINED – An absence from Full Senate shall be defined as not being accounted for at the time of the roll call immediately following the call to order, as well as not being accounted for at the time of the roll call immediately preceding adjournment. </strong></p>
<p><strong>(i) If a senator is accounted for at one of these roll calls but not the other, this shall be marked as half of an absence. </strong></p>
<p><strong>(ii) If a senator arrives within 20 minutes of the first calling of the roll, they shall be responsible for notifying a clerk of their arrival, and they shall be marked as present for the initial roll call</strong><strong></strong></p>
<p><strong>(b) COMMITTEE ABSENCE POLICY DEFINED – Committee Chairs shall be responsible for submitting attendance reports to the clerks after every meeting. </strong></p>

			<content:encoded><![CDATA[<div class='snap_preview'><br /><p><strong><span id="more-2042"></span></strong><strong>PURPOSE</strong>: To announce support for ‘Mizzou 4 Movember.’</p>
<p><strong>WHEREAS</strong>, ‘Mizzou 4 Movember’ is an official team registered on the behalf of the University of Missouri under the Movember United States Official website; AND</p>
<p><strong>WHEREAS</strong>, the “mustache” and the month of November come together to create ‘Movember’; AND</p>
<p><strong>WHEREAS</strong>, Movember is partnering with and raising funds for the Prostate Cancer Foundation and the Lance Armstrong Foundation in an effort to change the face of men’s health; AND</p>
<p><strong>WHEREAS</strong>, prostate cancer strikes 1 in 6 men and testicular cancer is the most common cancer in men aged 18 to 35; AND</p>
<p><strong>WHEREAS</strong>, The Prostate Cancer Foundation will use the money raised by Movember to fund research to find better treatments and a cure for prostate cancer; AND</p>
<p><strong>WHEREAS, </strong>The Lance Armstrong Foundation will use the money raised by Movember to fund the LIVE<strong>STRONG</strong> Young Adult Alliance program, which has the goal of improving survival rates and quality of life for young adults with cancer between the ages of 15 and 40, in addition to researching initiatives to further understand the biology of adolescent and young adult cancers.</p>
<p><strong>WHEREAS,</strong> this resolution will in no way create a financial obligation for the Association as a whole, but rather encourages individuals to participate in several unique ways.</p>
<p><strong>THEREFORE, BE IT RESOLVED BY THE MISSOURI STUDENTS ASSOCIATION SENATE</strong> that the Missouri Student Association fully supports ‘Mizzou 4 Movember.’</p>
<p><strong>BE IT FURTHER RESOLVED, </strong>that the men of the University of Missouri are encouraged to grow a mustache during the month of November in support of ‘Mizzou 4 Movember,’ to raise awareness of Movember and the issues of men’s health in which it addresses, and to raise funds for the Movember Foundation.</p>
<p><strong>BE IT FURTHER RESOLVED</strong>, that the women of the University of Missouri are encouraged to recruit supporters for Mizzou 4 Movember, to raise awareness of Movember and the issues of men’s health in which it addresses, and to raise funds for the Movember Foundation.</p>
